General Terms and Conditions

1 Scope of application

These General Terms and Conditions (hereinafter referred to as "GTC") of the Frezzo AG apply to all services and products (hereinafter referred to as "Products") of Frezzo AG. A customer is any natural and legal person who maintains business relations with Frezzo AG . Deliveries are limited to the territory of Switzerland and the Principality of Liechtenstein.

Conflicting or deviating terms and conditions of the customer are not recognized, unless Frezzo AG has expressly agreed to their validity in writing. The current and binding version of the GTC can be found at www.frezzo.ch. A written edition can be obtained from Frezzo AG .

2 Information about products and services

The information about products and services is provided by Frezzo AG for the customers as clearly and customer-friendly as possible. As far as these are information provided by the manufacturer (e.g. manufacturer's warranty), the information provided by the manufacturer himself is always decisive. Frezzo AG always endeavors to provide the manufacturer's information correctly, up-to-date and clearly, but cannot provide any guarantee for this. Illustrations in the shop may differ from the original product.

3 Price and availability

All prices are valid, unless otherwise stated, including VAT and any advance recycling fees / disposal fees and copyright levies.

Frezzo AG attaches great importance to carefully maintaining the availability information and showing it as correctly as possible. However, delivery delays may occur, in particular due to production or delivery bottlenecks. All information on delivery times is therefore without guarantee and may change at any time without notice. There is no claim for compensation in the event of late deliveries.

4 Conclusion of contract

Products, services and prices available at www.frezzo.ch are considered an offer. However, this offer is always subject to the (resolving) condition of an impossibility of delivery or an incorrect price indication on the part of the manufacturer or Frezzo AG.

The contract is concluded as soon as the customer places his order via the online shop, in the shop, by telephone or e-mail. The arrival of an online order is displayed to the customer by means of an automatically generated order confirmation to the e-mail address provided by him. The receipt of the automatically generated order confirmation does not contain any assurance that the product is actually available or can be delivered. It merely indicates to the customer that the order placed has been received by Frezzo AG and thus the contract has been concluded, which is subject to the condition of delivery possibility.

If delivery is impossible in accordance with Section 4, the contract will be terminated immediately and automatically. The customer will be informed of this immediately. If the customer has already paid, this amount will be refunded to him. If no payment has yet been made, the customer will be released from the obligation to pay. As a result of such a termination of the contract, Frezzo AG is not obliged to make a replacement delivery or replacement service.

5 Terms of payment

The customer undertakes to pay with the payment options provided. The current payment options and the associated conditions are published under frezzo.ch. Frezzo AG reserves the right to exclude customers from individual payment options without giving reasons.

Products delivered to the customer remain the property of Frezzo AG until full payment of the purchase price. The customer grants Frezzo AG the right to have a retention of title entered in the register of retention of title.

5.1.1 Purchase on account with partial payment option - a service of PowerPay

With the PowerPay invoice you can easily settle your online purchase by invoice with partial payment option. Mf Group / PowerPay offers the payment method "Payment by invoice" as an external payment service provider. When concluding the purchase contract, PowerPay takes over the invoice claim and processes the corresponding payment methods. When purchasing on account, in addition to our terms and conditions, you accept the terms and conditions of PowerPay. (powerpay.ch/de/agb). Please note that there is an administration fee per invoice and additional fees in accordance with PowerPay's terms and conditions for partial and late payments.

The invoice will be sent to you immediately after the order by e-mail from Order @ frezzo.ch. If the invoice is not paid within the 14 days - a monthly invoice will be issued by PowerPay with a fee of CHF 2.90 to you.

The invoice is payable within 14 days. The offer requires the creditworthiness check of the customer.

5.1.2 Purchase on account for business customers

The invoice will be sent by e-mail after a successful credit check and is payable within 14 days. The invoice may be refused by us.

From the second digital reminder, we charge CHF 15 reminder fees. For the 3rd and last reminder by registered mail, a total fee of CHF 35 will be charged.

If the payment is not paid on time according to our reminders and reminders, we commission Intrum AG for further processing.

Costs in case of late payment: Processing fee (at the earliest from day 70 after invoice date, when handed over to collection service providers) depending on the amount of the claim, maximum amount in CHF: 50 (up to 20); 70 (to 50); 100 (to 100); 120 (up to 150); 149 (up to 250); 195 (up to 500); 308 (up to 1,500); 448 (up to 3,000); 1,100 (up to 10,000); 1,510 (up to 20,000); 2,658 (up to 50,000); 6% of the claim (from 50,000).

5.2 Address search

If an invoice or reminder of the recipient address cannot be delivered, the customer will be charged a processing fee of CHF 20 per address search.

If the customer does not meet his payment obligations in whole or in part, all outstanding amounts that the customer owes Frezzo AG under any title shall become due immediately and Frezzo AG can claim them immediately and discontinue further deliveries to him. In the case of an order by advance payment, Frezzo AG at the earliest eight calendar days after Frezzo AG has unsuccessfully sent the customer a request for payment, may automatically terminate all affected contracts without further notice. Frezzo AG can charge a turnover fee of CHF 25 from the 2nd reminder. Frezzo AG reserves the right to assign the claim to a collection agency.

Discounts and promo codes cannot be cumulated.

6 Retention of title, set-off, right of retention

We reserve the right to retain ownership of the purchased item until full payment of the invoice amount. If you are an entrepreneur in the exercise of your commercial or independent professional activity, a legal entity under public law or a special fund under public law, we reserve title to the purchased item until all outstanding claims arising from the business relationship with the customer have been settled. The corresponding security interests are transferable to third parties.

You are only entitled to a right of set-off if your counterclaims have been legally established or are undisputed or acknowledged by us. In addition, a right of retention only applies if and to the extent that your counterclaim is based on the same contractual relationship. If the customer is in default with any payment obligations towards us, all existing claims shall become due immediately.

7 Cancellation and termination of contract

Orders are subject to para. 5 of the GTC binding and the customer is obliged to accept the service. Subsequent changes at the request of the customer are exceptionally possible and at the discretion of Frezzo AG . The possibility of cancellation depends on the product and the time of cancellation. Depending on the case, the order is free of charge, can be cancelled for compensation or not at all.

If the customer does not accept the products within two weeks despite the obligation to accept, Frezzo AG may terminate (cancel) the contract and invoice the handling costs. In the event of a delay in delivery of Frezzo AG in accordance with para. 4 of the GTC, the customer is entitled to withdraw from the contract at the earliest 30 calendar days after the agreed delivery date. In the event of cancellation due to non-delivery, Frezzo AG will refund amounts already paid in advance to the customer.

8 Delivery costs

All deliveries within Switzerland and the Principality of Liechtenstein are generally free of shipping costs from an order value of CHF 50. A small quantity surcharge of CHF 9.--. applies below CHF 50 

Excluded from this are the delivery costs to destinations that cannot be approached directly by the carrier (e.g. access only by mountain or cable car), as well as deliveries by a service partner. These costs are shown separately on the order and invoice.

9 Customer's obligation to inspect

The customer must immediately check delivered or collected products for correctness, completeness and integrity. Any defects must be reported to Frezzo AG immediately after detection, but at the latest within 5 calendar days after receipt of the shipment/collection. The customer must keep the product in the delivery condition and may not put it into operation.

Upon delivery by a service partner, the customer confirms with his signature on the delivery note that there are no obvious defects in the product. Otherwise, he must indicate the defect on the delivery note. This does not apply to hidden defects.

10 Exchanges, right of return, returns and refunds = always report to us

If something should not fit, you can benefit from the 14-day right of return. Please make sure that no signs of use are visible on the parts and everything is included - otherwise we have to refuse the return or impose a certain discount:

  • Unopened and originally packaged and sealed products (except hygiene articles) = The value of the goods will be refunded
  • Opened without signs of use with undamaged original packaging in full (incl. accessories) = 90% will be refunded
  • Opened with traces of use with original packaging and complete accessories = condition of the items must be checked and can be rejected
  • Damaged products or with missing accessories / original carton = no refund can be claimed

Returns of products are at the expense and risk of the customer. The return address (please do not send to Frezzo AG without prior agreement) will be communicated to you after contacting us. The products must be packed professionally and safely in the original packaging with all accessories.

The return due to a defect in the product must be accompanied by a detailed error description and a copy of the purchase invoice. In the case of products that have no detectable defects or that the defect is not covered by the manufacturer's warranty, Frezzo AG may charge the customer for the costs for the inspection as well as the return or disposal.

To clarify the further procedure, please contact us at mail@frezzo.ch - before sending the item back. After receipt of the rejected product, a suitable solution is sought. Be it by conversion (exchange), reduction (adjustment of the purchase price to the effective value) or refund of the purchase price.

Returns that cannot be assigned to a customer are kept for 12 months and then disposed of.

11 Warranty / Guarantee

The two-year warranty period from the date of delivery shall always apply, whereby Frezzo AG has the choice of providing the warranty by repair, replacement, rescission or reduction.

The warranty is only provided if there are no grounds for exclusion such as normal wear and tear, damage due to incorrect manipulation, interventions and manipulations as well as external circumstances such as elemental, moisture, fall and impact damage, etc.

In the case of wear parts such as brakes, V-belts, tyres, batteries and rechargeable batteries, the warranty Frezzo AG completely eliminated.

If the manufacturer's warranty goes beyond the warranty provided by Frezzo AG , Frezzo AG also grants this to its customer. Products marked as "Remanufactured" in the shop are demonstration products or returns from customers. They can have slight optical defects or be repaired products, which is why they are also sold at a reduced price. These optical defects are excluded from the warranty. Frezzo AG may, at its sole discretion, provide the Customer with a replacement product during the examination of the warranty claim. This is done under the (suspensive) condition that there is actually a case of warranty. Thus, the customer only acquires ownership of the replacement product at the moment of the warranty commitment. If the warranty is rejected, the customer may purchase the replacement product to him at the price of the time of delivery or he is obliged to return the replacement product in accordance with Section 12.

12 Repair after expiry of the warranty period or outside the warranty service

For repairs after expiry of the warranty period, Frezzo AG may charge costs.

13 reviews by real reviews

By agreeing to the terms and conditions in the checkout, the customer gives his informed and unambiguous consent that personal data about him will be used by the third-party provider Real Reviews to collect his rating on his purchase or transaction. Genuine Reviews will use the Personal Data exclusively for the performance of its service. Genuine reviews will in no case pass on personal data that could identify the buyer or harm his privacy.

The customer can object to this data transfer by e-mail to the following address: datenschutz @ frezzo.ch .

14 Liability

Claims for damages against Frezzo AG and their auxiliary persons are, as far as legally permissible, completely excluded. Liability for indirect damages and consequential damages resulting from use, failure or loss of performance is excluded. This exclusion of liability also applies to all types of direct and indirect damage (i.e. both personal injury, property damage and pure financial loss) caused by faulty or unprofessional assembly, installation, adjustment, maintenance or repair of the product by the customer. The company entrusted with the execution is liable for defects, delays in performance and damages that occur during the execution of service partner services (e.g. assembly on site).

15 FREE items

If Frezzo AG offers a "free article" in a promotion in the article text, on the pictures and/or in the text - applies while stocks last. There is no right to return due to free items not received. If a free item is deleted from the shopping cart (it is automatically listed as an item in the shopping cart and deducted as a minus item) - there is no right to subsequent shipping of the gifted item.

16 Privacy Policy

With the acceptance of the GTC, our privacy policy – also available at: frezzo.ch is automatically accepted.

17 Place of jurisdiction, applicable law and final provisions

Place of jurisdiction is Frauenfeld TG. The contract is subject to Swiss law, whereby the UN Convention on Contracts for the International Sale of Goods (CISG) is completely excluded.

Should one or more provisions of these GTC be invalid, this shall not entail the invalidity of the entire GTC. The invalid provision shall be replaced by the relevant statutory provision.
